Terms and Conditions – Villotti

1. Scope
   These Terms and Conditions (the “Terms”) apply to all orders placed through the online store operated by Villotti, Kummenweg 5, 6900 Bregenz, Austria, hosted on Shopify, by customers residing within the European Union.
   A “consumer” is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession (as defined by Austrian consumer protection law – KSchG).
   Any deviating terms and conditions of the customer will not be recognized unless Villotti has expressly agreed to their validity in writing.

2. Contract Partner and Conclusion of Contract
   The purchase agreement is concluded with Villotti, Kummenweg 5, 6900 Bregenz, Austria.
   The product presentations in our online shop are non-binding. By clicking the “Buy now” button, you submit a binding offer to purchase the goods in your shopping cart.
   After submitting your order, you will receive an automatic order confirmation by email. This confirmation does not yet constitute acceptance of your offer.
   The contract is only concluded once we expressly accept your order via email or by shipping the goods.

3. Delivery
   Delivery is made to the address provided during checkout within the European Union.
   Estimated delivery time is 7 to 21 business days, depending on the product and shipping service provider.
   If an item is unavailable, we will notify you promptly. In such cases, we reserve the right to cancel the order and refund any payments already made.

4. Prices and Shipping Costs
   All prices are final prices in euros (€).
   According to § 6 Abs. 1 Z 27 UStG, no VAT is charged (small business regulation).
   Shipping costs are displayed separately during the ordering process.
   For deliveries to other EU countries, additional local duties or handling fees may apply, which are the responsibility of the customer.

5. Payment
   Payment can be made using the payment methods offered in the online shop (e.g., credit card, PayPal, Klarna, Shopify Payments).
   The full invoice amount is due immediately upon purchase.

6. Right of Withdrawal for Consumers
   Consumers have the right to withdraw from the purchase contract within 14 days without giving any reason.
   The withdrawal period begins on the day you or a third party designated by you (other than the carrier) receives the goods.
   To exercise your right of withdrawal, you must notify us by sending a clear declaration (e.g., by email) to info.villotti@gmx.at.
   Consequences of Withdrawal: We will refund all payments received, including standard delivery costs, within 14 days after we receive the returned goods.
   You bear the direct cost of returning the goods, unless otherwise agreed.
   The refund will be made using the same payment method used for the original transaction.

7. Retention of Title
   The goods remain our property until full payment has been received.

8. Warranty
   Your purchase is covered by the statutory warranty rights under Austrian and EU law.
   In the event of defects, you are entitled to repair, replacement, price reduction, or cancellation of the contract in accordance with §§ 922 et seq. ABGB.

9. Liability
   Villotti is liable only for damages resulting from intent or gross negligence.
   Liability for slight negligence is excluded, except for personal injury or where otherwise required by law.

10. Data Protection
    Personal data is processed exclusively in accordance with the GDPR and the Austrian Data Protection Act (DSG).

11. Dispute Resolution
    Consumers residing in the European Union may use the European Online Dispute Resolution (ODR) platform provided by the European Commission.
    We are not obliged or willing to participate in dispute resolution proceedings before a consumer arbitration board.

12. Governing Law and Jurisdiction
    These Terms and all contracts between you and Villotti are governed by Austrian law, excluding the CISG.
    For consumers, the mandatory provisions of their country of residence apply.
    The place of jurisdiction for business customers is Bregenz, Austria.
